FQM to file motion for new trial before SC

KORONADAL CITY
- Former Koronadal City Mayor Fernando Miguel and South Cotabato gubernatorial candidateis set to file motion before the
Supreme Court for a new trial of his graft case.

The Miguel
camp’s move came after it discovered additional evidences to prove the former
city mayor was innocent of the charges.

Lawyer Nena
Santos, Miguel’s legal counsel, said she will present new set of evidences, including
a legal opinion from the Department of Interior and Local Government.

Speaking
during a news conference Monday, Santos said the DILG opinion substantially
disposed the interpretation of the department with respect to the jurisdiction
and powers conferred to the City or Provincial Legal Officers under RA 7160 or
Local Government Code (LGC).

DILG is the
government agency mandated to interpret provisions of the LGC.

Santos said Miguel’s
camp is bent on filing a case against the Atty. Romeo Sucaldito, currently South
Cotabato provincial legal officer for gross negligence of law and grave abuse
of power.

Other
complainants in this case could also face civil case before the court, Santos said.

The case stemmed
from a group of local media persons who filed a case against the Miguel about
10 years ago for having the services of a private notary public amounting to P419,000
pesos when he could have availed the services of the provincial legal office for
free.

Santos told
reporters that Miguel or his counsel had not received official copy of the SC
decision as publicly declared by the ex-mayors adversaries.
